1. Service Provider, Definitions and Scope
1.1. Service provider and contact details
Registered company name: T.R.F. Tasarım Danışmanlık A.Ş.

In these documents, ‘Company’ means the service provider identified above; ‘Platform’ means the digital service provided through renderailab.com; ‘User’ means a person who opens an account on or uses the Platform; ‘Buyer’ means a person who purchases a paid service; ‘Consumer’ means a natural or legal person acting for purposes unrelated to their trade or profession; ‘Business Customer’ means a Buyer acting for trade or professional purposes; ‘Token’ means the service usage unit used for generation and editing on the Platform; ‘Order Summary’ means the price, token, duration, payment, performance, withdrawal and termination information specific to an order; ‘AI Provider’ means a provider of an artificial intelligence model, API or technical infrastructure; and ‘User Content’ means images, projects, drawings, text, prompts, masks, guides, references, style samples and material samples uploaded to the Platform.
1.2. Distinction between consumers and business customers
A Buyer acting for purposes unrelated to their trade or profession benefits from consumer protection legislation. Whether a transaction is a consumer transaction is determined by its actual purpose and the statutory criteria, rather than the account name, invoice type or selected package. Using a business account does not by itself waive consumer rights.
Mandatory consumer provisions apply to consumer transactions; the Turkish Code of Obligations (TBK), Turkish Commercial Code (TTK) and relevant special legislation apply to trade or professional transactions. Terms included in a consumer contract without individual negotiation are subject to review for unfairness.
1.3. Sales channels and Order Summary
For products available for sale, subscriptions providing monthly token entitlements or one-time token packages may be purchased. The intended payment channel for card sales through the website is iyzico. You can purchase one-time token packages from your account. Newly purchased tokens are valid for two calendar months from the time payment is verified and they are credited. Monthly subscriptions are not available for purchase; a package appearing in the catalogue does not constitute an order or payment instruction. Recurring payment authorisation for a subscription is obtained separately. Purchasing a one-time package does not start a subscription or automatic top-up.
For direct sales separately offered by the Company with finalised terms, the quotation, order, contract and invoicing procedures apply; payment is made by bank transfer, EFT or FAST to the bank account specified by the Company.
The Order Summary is provided to the Buyer before acceptance and payment. It includes the purchased service, token quantity, price inclusive of all taxes, duration, payment and performance terms, any token validity and carry-over terms, and withdrawal and termination information. The Order Summary forms an integral part of the relevant contract.
2. Membership and Terms of Use
2.1. Account and security
The Platform provides digital tools for AI-assisted generation and editing of architecture, interior, landscape and industrial design/product images. Creating an account does not by itself constitute a paid order, subscription, card storage authorisation or recurring payment instruction.
The User is responsible for the accuracy of their account information and for protecting their access credentials. Suspected unauthorised access must be reported to the Company without delay. This obligation does not remove the Company's information and personal data security obligations.
2.2. Content and limited permission to use it
The User must hold the permission necessary to use uploaded content for the service. The existing rights of the User or third-party rights holder continue. The User grants the Company limited permission solely to perform the requested service, technically transform the content, retain it for the necessary period and transmit it to essential service providers.
This permission does not automatically authorise use of the content in advertising, a public portfolio or general-purpose model training. A separate lawful basis and, where required, separate permission must be obtained for those different purposes.
2.3. Content sent for an AI operation
The entire source image, together with any region, mask and landscape guides, style and material samples, instructions and necessary technical request data, may be sent to AI Providers for the selected operation. Locking a region or marking it for preservation does not mean the rest of the source image is not transferred or has been anonymised.
An instruction to start an operation cannot be interpreted as replacing the legal requirements for processing personal data or transferring it abroad.
2.4. Nature of outputs
AI outputs are intended for design and visualisation. They do not replace measurements, structural safety assessments, engineering calculations, material performance assessments, permits or certificates of regulatory compliance. The User performs the necessary professional checks before implementing an output or presenting it to third parties for professional purposes.
This explanation does not remove the Company's responsibility to properly perform the promised service or the Consumer's rights in relation to defective services.
3. Intellectual Property and AI Outputs
3.1. User content
Existing intellectual property rights in User Content remain with the User or the relevant rights holder. The Company acquires no rights in that content beyond the limited permission expressly stated in the contract.
3.2. Use of AI outputs
AI outputs created as part of a paid service may be used by the User for personal or commercial purposes and presented to clients to the extent legally possible and permitted by the applicable terms of the AI Provider disclosed before the operation.
This provision does not guarantee that every output qualifies as a work under the Turkish Law on Intellectual and Artistic Works (FSEK), that the User is always its author, that the output is exclusive or unique, or that it is definitively free of third-party rights.
3.3. Third-party rights
The User may not upload content that unlawfully infringes third parties' copyright, trademark, design, trade secret, personality or privacy rights. Following a specific infringement report, the Company may impose necessary and proportionate access restrictions or suspend the relevant operation.
Rights of recourse and compensation under the general provisions are reserved for damage caused by a Business Customer's unauthorised upload where fault and causation are established. This may not be interpreted as imposing unlimited or no-fault compensation liability on a Consumer.
4. Tokens, Charges and Operation Records
4.1. Nature and terms of tokens
A token is solely a service usage unit for generation and editing on the Platform. It is not money, electronic money, a deposit, a security or a payment instrument usable outside the Platform.
The token quantity, any validity period, carry-over between periods and order of consumption are shown in the Order Summary before payment. Expiry or usage restrictions not disclosed in advance are not subsequently applied to a previous order.
4.2. Operation cost and failed operations
The token cost of an operation is shown before it starts. If the input or options change, the current cost is shown again and the User's instruction to proceed is obtained.
Temporary token reservation, final usage recording and token refunds for failed operations are separate transactions. The same operation whose outcome is not yet confirmed is not charged twice. A token refund cannot be made a compulsory substitute for a monetary refund where the law requires one.
5. Confidentiality and Trade Secrets
5.1. Confidential information
Architectural projects, drawings, designs, client projects, unpublished work, technical information, business plans, pricing and trade secrets supplied by the User to the Platform that are confidential by their nature are treated as confidential information.
5.2. Duty of confidentiality
The Company uses confidential information solely to perform the contract and does not disclose it to third parties other than technical providers essential to the service. Access by staff and service providers is limited to what is necessary. Statutory disclosure obligations remain unaffected.
9. Retention, Deletion and Technical Periods
9.1. Retention and disposal
Personal data is retained for the period prescribed by applicable legislation or necessary for its processing purpose. When all grounds for processing cease to exist, it is deleted, destroyed or anonymised under Article 7 of the Turkish Personal Data Protection Law (KVKK).
Technical cleanup of ordinary private images on the Platform occurs when both conditions are met: the file is at least 14 days old and storage space is running low. This is not a promise to delete files on day 14. Material samples can be used for 30 minutes after a successful upload. These periods do not mean copies held by an AI Provider are deleted at the same time and do not override the separate retention periods for financial, security, token or evidence-of-rights records.
10. Pre-contract Information and Distance Sales
10.1. Pre-contract information
Before being bound by a contract, the Consumer is clearly and comprehensibly informed of the service's main characteristics, the Company's identity and contact details, the total price inclusive of all taxes, payment and performance terms, subscription duration, token terms, the right of withdrawal and its exceptions, and termination terms.
10.2. Formation and performance of the contract
In web sales, the Buyer can check their order and correct input errors. Immediately before final confirmation, it is clearly stated that the order entails an obligation to pay. The accepted Order Summary and contract are provided to the Buyer on a durable medium.
Contract versions published later do not retroactively change the accepted terms of a previous order.
11. Subscriptions and Recurring Payments
11.1. Subscription
The start, duration, recurring charge, token entitlement, any carry-over terms and method of terminating a subscription are shown in the Order Summary. Terminating a consumer subscription may not be made unnecessarily difficult; the method required for termination may not be more burdensome than the method used to enter into the contract.
Any fresh expression of intent required by legislation to extend a fixed-term consumer subscription is obtained separately.
11.2. Recurring payment authorisation and price changes
Separate payment authorisation is obtained for recurring collection. It applies only to the accepted plan, amount and payment schedule; it does not permit the collection of unlimited amounts to be set by the Company in the future.
Material changes to the price or core scope of the service are notified in advance and fresh acceptance is obtained where legally required. Silence is not acceptance of a new price.
12. One-time Token Packages and Direct Sales
12.1. One-time package
Each one-time token package purchase creates a separate order and payment. It does not start an automatic subscription, recurring collection or automatic top-up. The Order Summary states the token quantity, price inclusive of taxes, start of use, any validity period and order of consumption.
12.2. Direct sales
For a direct sale by the Company, the quotation identifies the service/package, quantity, price, taxes, validity period, payment schedule, performance date and account to which entitlements will be assigned. Payment by bank transfer does not by itself take a consumer contract concluded at a distance outside the scope of distance-contract rules.
13. Digital Delivery and Access to the Service
13.1. Delivery
Purchased entitlements are assigned to the correct account once payment is verified and the start conditions in the Order Summary are met. Assigning token entitlements to an account and completing image generation using those entitlements are separate stages. An AI Provider reporting completion does not by itself mean the result has been delivered in an accessible form on the Platform.
14. Withdrawal, Termination, Cancellation and Refunds
14.1. Right of withdrawal
Subject to statutory exceptions, the Consumer may withdraw within 14 days of concluding a distance service contract without giving a reason or paying a penalty. Sending notice of withdrawal to the Company within that period in writing or on a durable medium is sufficient; a special form is not required.
The consequences of failing to provide proper information about withdrawal apply as prescribed by legislation.
14.2. Withdrawal exceptions and early performance for digital services
The exceptions in the Distance Contracts Regulation for services performed instantly or intangible goods delivered instantly electronically, and for services whose performance begins with the Consumer's approval before the withdrawal period expires, are assessed separately according to the nature of the specific service.
Technically adding a token balance to an account cannot automatically be interpreted as instant performance of the entire service. Where approval for early performance is required, a separate active choice is obtained from the Consumer. Acceptance relating to membership, privacy information, the sales contract or recurring payment does not replace that choice.
14.3. Refunds
Amounts that must be refunded by law are returned within 14 days of the Company receiving a valid withdrawal notice, without charging the Buyer and using a method appropriate to the payment instrument. Where a monetary refund is legally required, the Consumer cannot be compelled to accept tokens or vouchers.
14.4. Subscription termination and unused advance payments
Stopping future collections, withdrawal and subscription termination are separate requests. When a consumer subscription ends, any unused advance-payment balance that must be refunded under legislation is returned within the statutory period. Termination does not automatically remove entitlements under separately purchased one-time packages.
14.5. Defective services and duplicate payments
For generation that could not start, has no confirmed outcome or has failed, records are reviewed and entitlement deductions are corrected according to the actual outcome. Duplicate collections are refunded.
The Consumer's rights in relation to defective services remain reserved, including repeat performance, free repair of the work resulting from the service, a price reduction proportionate to the defect, rescission of the contract and, where the conditions are met, compensation.
15. Service Interruptions and Liability
15.1. Third-party infrastructure
The Platform may depend on third-party services such as AI Providers, hosting companies, payment institutions and internet infrastructure. Planned maintenance, security interventions or third-party outages may cause temporary interruptions. The Company endeavours to give reasonable advance notice of planned and significant interruptions within its control.
If an AI model is withdrawn or becomes technically unavailable, an appropriate alternative may be offered provided this does not unfairly change the essential nature of the purchased service.
15.2. Limits of liability
Provisions agreed in advance that exclude or limit the Company's liability for intentional misconduct or gross negligence do not apply. Mandatory provisions of the Turkish Consumer Protection Law (TKHK) and review of unfair terms remain applicable to consumer transactions.
For Business Customers, the parties may separately regulate indirect loss, loss of profit, business interruption, service levels and liability caps in a specific business contract, within the limits of mandatory law.
16. Account Restrictions and Closure
16.1. Restrictions
In the event of unlawful use, a specific security risk or a serious breach of contract, the relevant operation or account access may be restricted as necessary and proportionate. Where possible, the User is informed of the reason and available means of redress. This power cannot be used to remove paid entitlements without cause or eliminate statutory refund rights.
Requests for account closure, subscription termination and personal data deletion are assessed separately in terms of their legal effects.
17. Optional Explicit Consent and Commercial Messages
17.1. Marketing and draft storage
Optional browser draft storage and personal data processing for campaigns/promotions are managed through separate choices according to the legal requirements of the relevant activity. Refusal of these choices is not made a condition of membership or paid services.
17.2. Commercial electronic messages
Approval for commercial electronic messages is obtained separately for campaign and promotional emails. Opting out is easy and free. Account verification, security, order, invoice, payment-result and support notifications are service communications; advertising beyond the scope of approval is not added to service notifications.
18. Separate Electronic Declarations
18.1. Principle of separate choices
The membership agreement, content rules, acknowledgement of reading the KVKK notice, pre-contract information, sales contract, recurring payment authorisation, fixed-term subscription extension, early performance, AI operation instruction, optional explicit consent and commercial electronic message approval are kept separate. One declaration does not replace another.
19. Order of Precedence and Standard Terms
19.1. Order of precedence
Subject to mandatory law, conflicts are resolved in this order: (1) a separately negotiated specific contract/quotation, (2) the Order Summary, (3) product-specific subscription or token terms, (4) the Distance Sales and Digital Services Agreement, and (5) the Membership and Terms of Use. KVKK notices, explicit consent and standard contracts under KVKK Article 9 are independent for their respective purposes.
19.2. Standard terms
Pre-drafted terms are applied with regard to TBK Articles 20–25. For standard terms contrary to the User's interests to be included, their existence must be clearly disclosed and the User must have an opportunity to learn their content. Unclear or ambiguous standard terms are interpreted against the drafter.
20. INSURANCE, RISK MANAGEMENT AND THE EFFECT OF INSURANCE COVER ON LIABILITY
20.1. Insurance cover
Taking into account the nature of its activities, service model, customer profile, categories of data processed and potential risks, the Company may obtain and maintain professional indemnity/errors and omissions (E&O), cyber risk and data security (Cyber Liability), third-party liability, directors and officers (D&O) and other insurance policies it considers necessary or appropriate. Depending on the policy's scope, cover may be arranged for risks arising from software and AI services, system or service errors, data security incidents, personal data breaches, cyberattacks and allegations by third parties of intellectual or industrial property infringement.
20.2. Artificial intelligence and intellectual property risks
Where appropriate to the nature of its AI-based products and services, the Company may obtain insurance cover for legal defence costs and compensation claims arising from allegations that AI-generated outputs infringe third-party copyright, trademarks, designs, patents, trade secrets or other intellectual or industrial property rights. The existence of insurance does not mean the Company guarantees that any AI output is lawful, unique or free of third-party rights.
20.3. Cyber risk and personal data protection
The Company may obtain cyber risk insurance for risks arising from unauthorised access, data leaks, malware, ransomware, service interruptions and similar cybersecurity incidents, and from unlawful acquisition or disclosure, loss or unavailability of personal data. Coverage and the insurer's obligation to pay are subject to the relevant policy's terms, coverage limits, deductibles and exclusions.
20.4. Insurance does not expand the Company's liability
The Company's taking out any insurance policy cannot be interpreted as: (a) assuming a new liability that does not exist under this Agreement or applicable legislation; (b) waiving a valid limitation of liability agreed in the Agreement; (c) increasing its liability cap to the coverage limit of the relevant policy; or (d) granting the User, Customer or any third party a direct right to the insured amount or policy limit.
20.5. Relationship with contractual liability caps
Where the parties have a specific provision limiting the Company's liability, the policy's coverage or payment limit is not treated as increasing the contractual liability cap, subject to mandatory law. The insurer's ability to pay an amount above that cap does not by itself raise the Company's contractual liability to the User, Customer or third parties by the same amount.
20.6. Exclusions from cover
The policy's exclusions, deductibles, waiting periods, sublimits and other coverage conditions remain applicable. An insurer excluding all or part of a loss from cover does not by itself create a new or additional contractual obligation for the Company to pay compensation.
20.7. Obligations of the User and Business Customer
The User and Business Customer must use the Company's services in accordance with the law, the Agreement, the terms of use and notified technical and security requirements. Liability arising from unlawful prompts/inputs, unauthorised uploading of third parties' personal data, trade secrets, copyright material, trademarks, designs or other protected elements, or use of the service for unlawful purposes is determined with regard to the circumstances, fault, causation and mandatory consumer provisions.
20.8. Disclosure of insurance information
Unless disclosure is required by law or a decision of a competent authority, the Company is not obliged to disclose the insurer's name, policy number, coverage amount, premium, deductibles or other policy terms to the User or third parties. Disclosure of an insurance document or coverage information does not by itself create an independent guarantee, a right of direct recourse against the insurer or an expansion of the Company's liability.
20.9. Mandatory provisions
This article cannot be interpreted as removing or limiting the Company's liability for intentional misconduct or gross negligence that cannot legally be excluded in advance, the Consumer's mandatory rights or mandatory personal data protection obligations.
21. Contact, Disputes and Final Provisions
21.1. Contact and requests
Requests concerning services, orders, invoices, payments, withdrawal, termination, refunds and personal data may be made through the contact channels in section 1.1. Choosing an incorrect heading does not cause loss of rights if the legal nature of the request is clear from its content. Opening a support ticket does not restart statutory response or refund periods.
21.2. Applicable law and disputes
Turkish law applies. The Consumer may apply to a consumer arbitration committee or consumer court in accordance with the monetary thresholds and jurisdiction rules applicable on the date of application. Pre-action mediation in consumer court proceedings applies subject to statutory exceptions. Relevant subject-matter and territorial jurisdiction rules and mandatory pre-action mediation provisions apply to commercial disputes. The Consumer's ability to seek redress in a legally competent venue is preserved.
21.3. Amendments and partial invalidity
New versions of the documents do not retroactively change the accepted terms of past orders to the User's detriment. The invalidity of one provision does not automatically affect the validity of the others.
No provision may be interpreted as an advance waiver of the Consumer's mandatory rights or the data subject's KVKK rights; as treating a privacy notice as explicit consent; as replacing KVKK Article 9 requirements with an AI operation instruction; or as eliminating the Company's liability for intentional misconduct or gross negligence where it cannot legally be excluded.
22. AI-SPECIFIC RISK ALLOCATION, USER INPUTS AND THIRD-PARTY SERVICES
22.1. User inputs and declaration of authority
The User agrees that they hold the necessary rights and permissions to use, reproduce, process and transmit to the Company for the relevant operation any prompts, text, images, drawings, designs, trademarks, logos, personal data, trade secrets or other content uploaded to or requested to be processed through the Platform, and that they will not provide content that unlawfully infringes third-party rights. For Consumers, this provision cannot be interpreted as imposing unlimited or no-fault compensation liability.
22.2. Nature of AI outputs
AI outputs may be created by probabilistic/generative systems; identical or similar inputs may produce similar outputs. Subject to mandatory law, the Company does not guarantee that an output is unique, error-free, complete, fit for a particular commercial purpose, definitively free of third-party rights or eligible for intellectual property protection in every case. The User must review the output for their intended use, especially before commercial or high-impact use.
22.3. Third-party AI/API providers
The Platform may use third-party AI models, APIs, cloud, payment, security or infrastructure providers to deliver the service. The Company fulfils its selection, integration, disclosure and security obligations within its control. Consequences of changes, capacity limits or interruptions in third-party services that are not attributable to the Company are assessed in light of the circumstances. This provision does not release the Company from its own fault or liability that cannot legally be limited.
22.4. Beta, experimental and preview features
Features expressly labelled beta, experimental, preview or test may change in functionality, model, capacity and technical limits. If used in production or critical business processes, the User must provide the necessary backups, validation and human oversight. Mandatory consumer rights remain unaffected.
22.5. Prohibited use and protective intervention
For use clearly contrary to law or the Agreement, such as unlawful personal data processing, infringement of third-party intellectual property rights, impersonation, bypassing security measures, harmful automation, unauthorised API/token sharing, system disruption or reverse-engineering attempts, the Company may stop generation, restrict access to content or temporarily suspend the account, proportionately to the severity and urgency of the breach. Permanent termination or severe restrictions are applied with reasons and proportionately within applicable legislation and contractual provisions.
22.6. Specific B2B risk allocation
For Business Customers, third-party claims arising from unlawful or unauthorised inputs and losses arising from the Customer's own usage decisions are assessed under the general provisions, taking fault, causation, foreseeability and the parties' areas of control into account. The Company's intentional misconduct or gross negligence and liabilities that cannot legally be limited are excluded from this allocation. This provision is not applied to consumer transactions in a way that narrows mandatory consumer rights.
22.7. Records, evidence and retention
The Company may keep contract versions, acceptance records, operation times, token movements, model/provider information, security records and other technical records needed to establish facts in a dispute, in a manner relevant, limited and proportionate to their purpose. Retention periods are determined with regard to legal obligations, the establishment, exercise or protection of rights, and data minimisation. Personal data whose grounds for processing have ended is deleted, destroyed or anonymised under applicable legislation.
ANNEX 15 – PROTOCOL ON AI OUTPUTS, PROMPTS AND USER RESPONSIBILITY
1. The User is responsible for the lawfulness of prompts and other inputs supplied to the Platform and for holding the necessary permissions to use them.
2. The User must not upload third parties' personal data, trade secrets, trademarks, designs, copyrighted works or other protected elements without a legal basis or authority.
3. AI outputs may be probabilistic; no absolute guarantee is given of accuracy, uniqueness, fitness for a particular purpose or complete freedom from third-party rights.
4. The User performs the necessary legal, technical and professional checks before commercial use.
5. Third-party claims arising from a Business Customer's unlawful or unauthorised inputs are assessed according to the parties' fault, causation and areas of control. Unlimited or no-fault compensation liability is not imposed on Consumers.
6. The Company's liability for intentional misconduct or gross negligence and liabilities that cannot legally be limited remain unaffected.
ANNEX 16 – PROTOCOL ON PROHIBITED USE, SECURITY AND ACCOUNT INTERVENTION
The following uses are prohibited: (i) unlawful processing of personal data or special categories of personal data; (ii) use that knowingly infringes third-party intellectual/industrial property rights; (iii) impersonation or creating a misleading impression of authority; (iv) bypassing security controls or producing/distributing malicious code or attacks; (v) unauthorised API/token/account sharing; (vi) automation that disrupts the integrity or availability of the Platform; and (vii) legally prohibited content or activities.
Where there is a clear and imminent risk, the Company may immediately apply temporary protective measures. In other cases, depending on the nature of the breach, it may issue a warning, restrict content/operations, temporarily suspend access or, as a last resort, terminate. Measures must be proportionate and preserve consumer rights and mandatory provisions.
ANNEX 17 – PROTOCOL ON SERVICE LEVELS, INTERRUPTIONS, BETA FEATURES AND THIRD-PARTY PROVIDERS
1. The Company takes the measures necessary to operate the Platform with reasonable continuity and security. Unless an express written SLA is provided separately, this is not a commitment to uninterrupted or 100% available service.
2. Planned maintenance is announced in advance where possible. Advance notice may not be possible for urgent security interventions.
3. Interruptions at third-party AI/API, cloud, payment or infrastructure providers that are not attributable to the Company are assessed according to the circumstances.
4. Beta/experimental/preview features are clearly labelled; their functionality may be changed or removed. Acquired consumer rights and mandatory rights relating to an existing paid period remain unaffected.
5. For critical business processes, the User must provide their own backups, verification and human oversight.
6. Force majeure is assessed on the basis of causation and its effect on performance in the particular case.

1. Üyelik ve Kullanım Koşulları
1.1. Taraflar ve kapsam
torfmimai, T.R.F. Şirketin adresi Gülbahçe Mahallesi, Gülbahçe Caddesi, Kuluçka Merkezi Binası Sitesi, No: 1-45, D: 21, Urla, 35430 İzmir, Türkiye; e-posta adresi info@torfdesignlab.com; telefon numarası +905059744468’dir.

6. Uploaded Content and Personal Data Rules
6.1. Principle of not uploading personal data
The Platform is not offered for processing images or documents containing personal data or special categories of personal data. Before uploading, the User should assess and, where possible, remove elements such as identity and contact details, faces, health and biometric data, signatures, vehicle registration plates, client lists, title deeds, addresses and precise locations.
Blurring or locking a region does not always constitute anonymisation.
6.2. Procedure for incorrect uploads
If an upload is found to contain personal data or special categories of personal data that are not necessary for the service, processing is stopped, access restricted and appropriate deletion/destruction procedures applied to the extent technically and legally possible. Whether the User must also be informed or a data-breach procedure initiated is assessed in the specific case.
